One may file for a California divorce if either of the parties have lived in the state for at least six months. Ours is a “no fault” divorce state; it is not necessary to prove that either spouse was “wrong.” The Court will grant a marriage dissolution on the broad grounds of irreconcilable differences. If the parties are in complete agreement on all issues then their divorce may be completed as an uncontested divorce. Most cases, however, involve some sort of disagreement. Any such disagreement means that the parties will have to go through the contested process instead.
A contested divorce begins with one spouse filing a Petition stating the reason for the marriage dissolution and what it is they want from the outcome. The other side will file a response and each party will be required to disclose financial information to the Court. An early hearing will typically be held at which the Judge will issue an order determining temporary child custody, child support, possession of particular marital property, and spousal support. Each spouse will be given a chance to use discovery (the process by which information is gained from the other side) to build a case as to why they should be awarded the custody, property, and support levels which they have requested. The matter will culminate at a bench trial where a Judge, not a Jury, will make a final ruling on all issues. Hiring an attorney to assist with the matter can improve your chances of gaining the outcome you desire.
