Handling Disability Discrimination Cases For Santa Ana, California Employees

This is the first post in a series which will discuss the handling of disability discrimination cases on behalf of Santa Ana employees. We decided to write on this topic due to the fact that many are unsure of their rights when they have been the victim of a wrong. Our goal with this series is to provide information which will help people make an informed decision when selecting an attorney. If you have been mistreated by your employer, on the basis of a disability, it is strongly suggested that you contact a lawyer immediately.

We will be discussing several topics over our coming posts. Issues which we will address include:

  • What constitutes disability discrimination
  • Filing a claim with the FEHC
  • The importance of discovery after filing a lawsuit
  • Taking such a case to trial

These are important topics for several reasons. First, some make the mistake of thinking they have been the victim of discrimination when, in fact, the employer has broken no law. More importantly, there are those who have been victimized and either do not realize that their rights have been violated or believe that they have no recourse. Second, if one does not properly take their case through the FEHC process then they may possibly not have the right to be compensated. Third, an employee must have objective evidence of discrimination when presenting a case in Court. Discovery is the process by which such evidence is gathered and is imperative in proving one’s case. Finally, knowing what to expect from the trial process will assist a Plaintiff in being more prepared.

It is important that you take action immediately if you feel that your rights have been violated. You will only have a limited amount of time in which you can bring a claim against your employer. This time starts to tick away once the last act of discrimination occurs. If you fail to take action, before time expires, then you will lose the right to seek relief. Also, the sooner you take action against your employer then the easier it will be to build a case. It will be easier to locate witnesses, fellow employees will be less likely to have moved on, and there will be a greater chance that documentation or records of your employer are available. There is no good reason to wait to hold a consultation with counsel.
